1. Validity of Terms
1.1. These terms (hereinafter referred to as the Terms) regulate the rights and obligations arising from the mediation of services between the customers (hereinafter the Client) of the electronic Internet shopping environment at www.chilli.ee, operated and owned by Chilli Deals OÜ, registry code 11998579, legal address Mõisa 4, Tallinn, Harju County, 13522, Estonia (hereinafter chilli.ee), which acts as an intermediary, and the merchants mediated by chilli.ee (hereinafter also referred to as the Merchant in singular and/or Merchants in plural), each separately referred to as a Party and collectively as the Parties.
1.2. The chilli.ee online shopping environment is primarily intended for presenting the services sold by the Merchant (hereinafter also referred to as Goods) to the Client and conducting the sales transaction.
1.3. The contract concluded via chilli.ee between the Client and the Merchant is a three-party legal relationship, where chilli.ee undertakes to mediate the conclusion of a contract between another person (the Merchant) and a third party (the Client), or to provide the possibility for such contract conclusion (hereinafter also referred to as the Contract).
1.4. Each product offered by chilli.ee includes information about the Merchant. If the Client requires additional information about the Goods, they have the right to contact chilli.ee via the contacts published in the shopping environment, or directly the Merchant if necessary.
1.5. In addition to the information provided by chilli.ee, the Merchant may provide the Client with additional information/instructions about the Goods if needed.
1.6. In aspects not regulated in the Terms, the Client and chilli.ee follow the applicable legal requirements.
1.7. Chilli.ee is not a party to the Sales Agreement concluded between the Merchant and the Client. The Merchant is responsible for fulfilling the Sales Agreement, including, but not limited to, the availability and quality of the Goods.
1.8. Upon conclusion of the Sales Agreement, chilli.ee issues a coupon (hereinafter also referred to as a Voucher) to the Client via email and/or mobile message, based on which the Client can consume or acquire the purchased Goods from the Merchant.
1.9. The coupon includes the name, value of the purchased Goods, Merchant's name, period for redemption at the Merchant, coupon number, and other details and any special conditions.
1.10. Due to the character limit of SMS, the amount of information in such messages may be smaller, but the coupon remains usable under the same conditions.
1.11. To redeem the purchased service at the Merchant, the Client must present the coupon number, PIN code, and other details issued at the time of purchase, either printed or shown from a mobile phone.
1.12. The promotional material about the Goods is provided to chilli.ee by the Merchant, and chilli.ee is not responsible for its accuracy as it may not always have the correct information.
1.13. Chilli.ee has the right to unilaterally change the Terms and price list. Changes and additions come into force from the moment they are published on www.chilli.ee. Orders submitted before the changes are governed by the terms valid at the time of order placement.
1.14. By purchasing from the chilli.ee online store and/or registering as a user, the Client confirms they have read and agree to the Terms and commit to following them.
2. Price List
2.1. Prices of products sold in the chilli.ee online store are shown in euros, exclude shipping costs, and include 22% VAT applicable in the Republic of Estonia (unless stated otherwise).
2.2. Chilli.ee reserves the right to change prices. For the Client, the price valid at the time of order submission, as shown on the coupon, applies.
2.3. Products offered via the chilli.ee online shopping environment are offers from the Merchant to the Client for sale. Some offers include only specific discounts at the Merchant. Upon redeeming the coupon, the Client may be required to pay the remaining amount for the product or service after applying the purchased discount.
2.4. The discount mentioned in most offers is indicative and shows the usual sale price at the Merchant compared to the price offered through chilli.ee. The percentage is primarily indicative to assist the Client in making a decision.
3. Order Placement and Payment
3.1. The Client's shopping cart is created once they click “Buy Now” or “Add to Cart”. The Client can continue browsing or proceed to order. Products in the cart can be added, changed, or removed before confirming the order.
3.2. Flexible return terms can be added in the cart, allowing voucher/gift card returns beyond the legal 14-day right. Returns must occur before the expiry of the voucher or gift card. This is an optional service that must be selected before completing the transaction.
3.2.1. If the purchased service (experience or gift card) is under €20, a €1 fee applies.
3.2.2. If the value is €20 or more, a €2 fee applies.
3.3. A 3% platform fee applies to all purchases, with a minimum of €0.29 and a maximum of €1.99. The fee supports platform maintenance, technology, and payment processing. The fee applies to the total cart amount and may be waived under certain conditions or promotions.
3.4. Product images are illustrative and may differ from the actual product.
3.5. Purchasable vouchers are usually labeled “Voucher” or “Gift Card”.
3.6. To complete the order, the Client must confirm the cart, enter the requested data, and choose a payment method. The Client is then redirected to Montonio for payment. The Agreement is deemed concluded when payment is made to chilli.ee.
4. Right of Return
4.1. The Client has the right to withdraw from the purchase within 14 days if the purchase was made online or via other remote means, especially via chilli.ee.
4.2. The right of return does not apply to entertainment, travel, hotel bookings, dated catering, or other services excluded by law.
4.3. Upon return approval, the unique security codes for the Goods are immediately voided by chilli.ee customer support.
4.4. Refunds are processed within 10 business days. In exceptional cases, delays may occur due to refund processing peculiarities of payment partners, and clients will be notified accordingly.
5. Force Majeure
5.1. Neither party is liable to the other for delays or failures due to circumstances beyond their control (legally termed as force majeure).
6. Personal Data Protection
6.1. More detailed information about personal data processing is available on the Personal Data Processing page.
7. Final Provisions
7.1. Disputes arising from compliance with the Terms shall be resolved primarily through negotiations. If no agreement is reached, either party may turn to the Consumer Protection Board (TTJA) or court.
7.2. The Terms and the Sales Agreement are governed by Estonian law. If any provision is void, the rest remain valid. The void provision will be replaced with a lawful one closest in meaning and effect.
7.3. All information included with each Goods offer is considered an integral part of these Terms.
